License to Carry or Texas Constitutional Carry?
Texas law provides more rights and benefits to LTC holders.
Reciprocity - Currently there are about 21 states where carry is only possible with the LTC. Some states with their own Constitutional Carry limit that right to their residents only.
Federal Gun-Free School Zones – prohibit carry within 1000 feet of public, private, or parochial elementary, middle, or high schools. This prohibition does not apply to those with a License to Carry permit.
Firearm Purchases – No ‘NICS’ background check is required for purchase of a firearm by an LTC holder from an FFL.
LTC ages 18-20 – military members and those honorably discharged may obtain an LTC prior to age 21.
NICS Denial Notification Act of 2022 - requires FFLs (Gun Dealers) to report Background Check Denials.
School District Employees with an LTC Are Protected – The rights of school employees with LTC’s are protected regarding storing a handgun in their vehicle. There is no protection for non LTC holders.
Private Property Owners May Prevent Constitutional Carry – Business owners uneasy about those carrying without permits & training can prohibit Carry under this law without restricting LTC holders.
LTC Holders Are entitled to More Notice at Some Prohibited Locations - carry by an LTC holder onto certain prohibited places lacking proper signage cannot be enforced.
Non – LTC Holders may still be prosecuted for carrying onto these prohibited places lacking the proper signage.
LTC Holders are provided an ‘Oops’ at Airports in Texas - for accidentaly entering airport security with a handgun. Unlicensed persons making this mistake face a felony arrest. LTC holders are given a warning and the opportunity to remove the firearm.
